Right of Withdrawal in France – Distance Selling
General Conditions:
In France, in accordance with Article L221-18 of the Consumer Code, consumers have a right of withdrawal when purchasing products remotely. This right applies to purchases made online, by phone, or by mail order.
Duration of the Right of Withdrawal:
The consumer has a period of 14 days from the receipt of the product to exercise their right of withdrawal, without having to give any reason or pay any penalties.
If the 14-day period ends on a Saturday, Sunday, or public holiday, it is extended to the next working day.
If the seller did not provide information about the right of withdrawal before the contract was concluded, the withdrawal period is extended by twelve months from the end of the initial withdrawal period (Article L221-19 of the Consumer Code).
How to Exercise the Right of Withdrawal:
The consumer must notify their intention to withdraw within the 14-day period.
This notification can be made by any means, but it is recommended to do so in writing (registered letter with acknowledgment of receipt, email, online form, etc.).
The consumer may use the withdrawal form provided by the seller, but this is not mandatory.
Consequences of Withdrawal:
In case of withdrawal, the consumer will be reimbursed in full, including standard delivery fees (excluding any additional costs arising from the choice of a delivery method other than the standard one offered by the seller).
Return shipping costs are the responsibility of the consumer.
Reimbursement must occur within 14 days of receiving the returned goods or proof of shipment, whichever comes first.
Exceptions to the Right of Withdrawal:
Some goods and services are excluded from the right of withdrawal, such as:
Custom-made or personalized items,
Perishable goods,
Sealed goods that cannot be returned for health protection or hygiene reasons once opened, etc.
